Employment-Based Immigration: first Preference EB-1


You might be eligible for an employment-based, first-preference visa if you are an alien of remarkable ability, are an outstanding professor or scientist, or are a particular multinational executive or manager. Each occupational classification has specific requirements that should be fulfilled:

Your petitioning needs to be a U.S. employer and mean to use you in a managerial or executive capacity. The petitioner should have been doing business in the U.S. for a minimum of 1 year, as a legal entity with a certifying relationship to the entity that used you abroad in a managerial or executive capacity.

No labor accreditation is required.

* Criteria for Demonstrating Extraordinary Ability

In order to demonstrate you have actually sustained national or international acclaim which your achievements have actually been acknowledged in your field of knowledge, you need to either include evidence of a one-time achievement (major internationally-recognized award) or 3 of the 10 listed criteria listed below (or similar proof if any of the requirements do not readily apply):

- Evidence of your membership in associations in the field which demand outstanding achievement of their members
- Evidence of published product about you in professional or significant trade publications or other significant media

- Evidence of your original scientific, scholarly, creative, athletic, or business-related contributions of significant significance to the field
- Evidence of your authorship of academic short articles in professional or significant trade publications or other significant media
- Evidence that your work has been displayed at creative exhibits or displays
- Evidence of your efficiency of a leading or vital role in distinguished companies
- Evidence that you command a high salary or other substantially high reimbursement in relation to others in the field
- Evidence of your industrial successes in the carrying out arts

** Examples of Documentary Evidence That a Person is an Outstanding Professor or Researcher

In order to demonstrate you are an outstanding teacher or scientist, employment you need to consist of evidence of 2 of the 6 noted criteria below (or equivalent proof if any of the requirements do not readily use):

- Evidence of invoice of significant rewards or awards for outstanding accomplishment
- Evidence of subscription in associations that need their members to show impressive accomplishment
- Evidence of released material in professional publications written by others about the alien's operate in the scholastic field
- Evidence of participation, either on a panel or separately, as a judge of the work of others in the same or allied scholastic field
- Evidence of initial clinical or employment scholarly research contributions in the field

Application Process

Extraordinary Ability: You may make an application for yourself by filing a Type I-140, Petition for Alien Worker.
Outstanding Professors and employment Researchers: Your U.S. company should submit a Form I-140, employment Petition for employment Alien Worker. As part of the application process, your company should have the ability to demonstrate a continuing ability to pay the used wage as of the top priority date. Your employer might utilize an annual report, federal income tax return, employment or audited financial statement to show a continuing capability to pay your wage.
Multinational Manager or Executive: Your U.S. company should file USCIS Form I-140, Petition for Alien Worker. As part of the application process, your employer should be able to demonstrate a continuing ability to pay the used wage since the top priority date. Your employer might utilize a yearly report, federal tax return, or audited financial statement to demonstrate a continuing ability to pay your wage.
