Employment-Based Immigration: very First Preference EB-1


You may be qualified for an employment-based, first-preference visa if you are an alien of remarkable capability, are an outstanding professor or scientist, or are a particular multinational executive or manager. Each occupational category has particular requirements that should be satisfied:

Your petitioning employer must be a U.S. employer and mean to use you in a managerial or executive capacity. The petitioner needs to have been doing business in the U.S. for at least 1 year, as a legal entity with a qualifying relationship to the entity that employed you abroad in a supervisory or executive capability.

No labor certification is needed.

* Criteria for Demonstrating Extraordinary Ability

In order to show you have sustained nationwide or international recognition and that your achievements have actually been recognized in your field of knowledge, you should either consist of proof of a one-time achievement (major internationally-recognized award) or 3 of the 10 noted requirements listed below (or similar evidence if any of the criteria do not readily use):

- Evidence of receipt of lesser nationally or internationally acknowledged rewards or awards for excellence
- Evidence of your membership in associations in the field which require exceptional achievement of their members
- Evidence of released product about you in professional or significant trade publications or other significant media
- Evidence that you have been asked to evaluate the work of others, either individually or on a panel
- Evidence of your original scientific, scholarly, artistic, athletic, or business-related contributions of major significance to the field
- Evidence of your authorship of scholarly articles in expert or major trade publications or other major media
- Evidence that your work has actually been shown at artistic exhibitions or displays
- Evidence of your efficiency of a leading or crucial function in prominent organizations
- Evidence that you command a high wage or other considerably high remuneration in relation to others in the field
- Evidence of your business successes in the performing arts

** Examples of Documentary Evidence That a Person is an Exceptional Professor or Researcher

In order to show you are an impressive professor or researcher, you need to consist of proof of 2 of the 6 noted requirements below (or similar evidence if any of the requirements do not easily apply):

- Evidence of invoice of major rewards or awards for outstanding accomplishment
- Evidence of membership in associations that require their members to demonstrate exceptional achievement
- Evidence of published product in professional publications composed by others about the alien's work in the scholastic field
- Evidence of involvement, either on a panel or separately, as a judge of the work of others in the same or allied academic field
- Evidence of original scientific or academic research study contributions in the field
- Evidence of authorship of scholarly books or articles (in scholarly journals with global blood circulation) in the field

Application Process

Extraordinary Ability: You may request yourself by filing a Type I-140, Petition for Alien Worker.
Outstanding Professors and Researchers: Your U.S. employer must file a Type I-140, Petition for Alien Worker. As part of the application process, your employer must be able to demonstrate a continuing capability to pay the provided wage since the priority date. Your company might utilize an annual report, federal income tax return, or audited monetary statement to demonstrate a continuing capability to pay your wage.
Multinational Manager or trademarketclassifieds.com Executive: Your U.S. employer must file USCIS Form I-140, Petition for Alien Worker. As part of the application procedure, your employer should be able to show a continuing capability to pay the used wage as of the priority date.
